Dance Classes, Workshops and Courses including Online Courses
By taking part in any Dance Kizomba class, workshop or lesson you are acknowledging you have read, agree to and accept all of the terms and conditions below.
1.Scope of Participation:
1.1 Participants are responsible for declaring any physical and/or medical limitations, which may affect their ability to participate before the start of their first class or the first class after the limitation arises.
1.2 The Participant assumes responsibility of checking with their medical practitioner, physiotherapist, or other health care professional for medical readiness prior to participating.
1.3 The Company is dedicated to providing a Programme which is personalised to the participants as much as is possible within the chosen Programme. Whilst every effort is made to keep the Programme both safe and effective there is a risk of injury with every physical activity. The participant acknowledges that they are taking part of their own free will, and are aware of risk. The Participant agrees that neither they, their heirs, assigns nor legal representatives will sue or make any other claims of any kind whatsoever against the Company whether for personal injury, property damage/loss or wrongful death, whether caused by negligence or otherwise.
1.4 We reserve the right to refuse access to any Programme participant, if in our absolute discretion, we consider that the health of the individual concerned may be endangered.
1.5 The Participant agrees that the Programme is non-transferable and is only for use by the Customer who has signed up to the Programme.
1.6 We are committed to providing all Programme participants with a positive experience. By participating, you agree that the Company may, at its sole discretion, terminate this Agreement, and limit, suspend, or terminate your participation in the Programme without refund or forgiveness of monthly payments if you become aggressive, disruptive or difficult to work with.
1.7 The minimum age required to participate in adult classes is 16. All applicants under the age of 18 years must have consent, in written form, from a parent or guardian.
Please arrive at least 10 minutes prior to the start of your class in order to sign in, settle accounts and change. Our classes start promptly at the time advertised in order to adhere to booking arrangements with our venues.
In the event of lateness participants arriving more than 5 minutes after the stated start time of the class may be refused entry to the class at the instructors discretion.
Group classes (all sessions) are between 45-60mins long.
Where instructed, please leave the venue quickly and quietly after sessions as to not disturb or delay other classes, groups or venue users.
3. Hours and Weeks of Programme:
3.1 Because we believe in having balance in our lives, and recommend the same to our clients, the Company operates for 50 of the 52 weeks of the year and sessions will be arranged accordingly. These weeks start afresh as of the 1st January.
3.2 Participants are asked to arrive timely for sessions. You agree to arrive at least 10 minutes before your scheduled session time to ensure a smooth change over and/or you are ready to begin on time.
4. For your comfort and house-keeping:
Please provide an accurate physical / medical history where nessessary
Kizomba is a “hands on” approach. If this is uncomfortable for you in any way, please inform us.
Please wear comfortable clothing that will enable your instructor to observe the functioning of your body. Comfortable shoes with a flat sole or small heel should be worn at all times, please do not wear running shoes as they can provide too much ‘grip’ and injure or aggravate joints.
Mobile conversations are not allowed in the studio. Please “silence” your phone. Your courtesy will be appreciated.
5. Class, Workshop and Course Payments / Cancellations / Refunds:
Payment for classes and workshops must be made in advance we do not accept walk-ins to any of our courses
Payment can be made by (1) Debit/credit card (2) Paypal (3) Electronic transfer (BACs) (4) Using a credit/debit card online or over the phone.
Missed sessions without the appropriate notice will be charged as if attended.
Where courses include online content participants missing classes in a course should reviews this material in order to be prepared for the following lesson. If your course does not include online material and missing a class is unavoidable please contact Francesca to enquire if catch up material is available
If you choose to cancel your course this must be done on the 15th of each month so that we can ensure that payment is not taken on the 1st of the following month.
5.6 Cancellations must be made by text telephone call to 07534994646 before editing your subscription in the ‘my account’ section of our website.
Refunds are considered in the following circumstances: –
- An undeniably unavoidable circumstance prevents you from taking part in your programme (determined on a case by case basis by the Company). Written evidence to support this may be requested.
- We are notified of your circumstances 72 hours before the commencement of the Programme
Refunds are not payable in the following circumstances: –
• You have changed your mind.
• Refunds are not payable for Sessions which have taken place
• You don’t complete your programme.
• You have booked Kizomba Sessions and are not at the agreed location to receive the session at the appointed time.
- An appointment needs to be cancelled by the Company due to severe external conditions. An alternative appointment will be offered for a future appointment or an additional class will be added to your next month’s allowance of classes.
6. Personal Property:
6.1 Personal property brought to sessions are done so at the participants own risk and the Company does not accept liability for any loss or damage whatsoever to such items. For security reasons participants are advised to leave valuable items at home, and to keep personal belongings with them at all times.
6.2 Any lost property handed-in will be retained by staff and should be claimed within a 2week period.
7. Changes to Programme:
7.1 Because we believe in constant improvement, you agree that the form and nature of the Programme may change and a monthly basis without prior notice.
7.2 Every effort will be made by Dance Kizomba to notify participants of changes to the program. Where changes are planned they will be communicated in a timely manner in person and via email. Sometimes unplanned changes to the program are unavoidable, where last minute changes need to be made Dance Kizomba will communicate these changes via the group class Facebook Messenger conversations as the fastest way in communicate with the large group of attendees at class quickly.
8. Venues/Changes to Venues:
8.1 As a participant you agree to comply with the rules of the venue relating to opening hours, use of the facilities and conduct.
8.2 Where necessary Dance Kizomba reserves the right to change venues. Every effort will be made to make sure replacement venues are as accessible to participants as the advertised venue.
8.3 Every effort will be made by Dance Kizomba to notify participants of changes to the venue. Where changes are planned they will be communicated in a timely manner in person and via email. Sometimes unplanned changes to the program are unavoidable, where last minute changes need to be made Dance Kizomba will communicate these changes via the group class Facebook Messenger conversations as the fastest way in communicate with the large group of attendees at class quickly.
9. Media and technology:
9.1 Clients recognise that technology is a powerful tool within marketing and sharing amazing results with members of the public. Therefore, Clients give permission for photography, filming and social media communication can take place during (and outside) the Programme and unless otherwise told the Company has permission to display media such as photos and videos of Clients on facebook/website and other marketing sources.
8.2 Clients understand that any comment they say/write/film can be used as a testimonial to promote the Company. This includes photos as well.
8.3 Dance Kizomba will regularly use Facebook Messenger to communicate with participants. Please ensure you have an account and have been added to the relevant ‘chat’ to receive direct messages to your phone to stay up to date.
8.4 Facebook Messenger group chats and Facebook Groups can be used to communicate with the group about Kizomba classes, events, music and other social information. Participants agree to use these platforms only as intended and not for personal gain or to promote events they are involved in organising without express permission from Francesca Owen. Participants are advised to not share personal information in semi-public discussions.
We respect your privacy and must insist that you respect the privacy of fellow Programme participants. By participating, you agree not to violate the publicity or privacy rights of any participant.
(1) not to infringe any participant’s or the Company’s copyright,
(2) that any Conﬁdential Information shared by participants or any representative of the Company is conﬁdential and proprietary, and belongs solely and exclusively to the participant who discloses it or the Company,
(3) you agree not to disclose such information to any other person or use it in any manner other than in discussion with other participants during sessions.
By signing this Agreement, you further agree that
(4) all materials and information provided to you (for example instructional videos) by the Company are its conﬁdential and proprietary intellectual property, belonging solely and exclusively to the Company and may only be used by you as authorised by the Company.
(5) the reproduction, distribution and sale of these materials by anyone but the Company is strictly prohibited.
Further, by participating, you agree that, if you violate, or display any likelihood or violating, any of your agreements contained in these terms and conditions, the Company and/or other participant(s) will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.

We have made every effort to accurately represent the Programme and their potential. Each individual’s results depend on many factors, including their individual considerations from the outset, his or her dedication, desire, and motivation. By accepting these terms and conditions you acknowledge and agree to all of the above.
Merchandise & Printed Purchases
Purchase of Merchandise
13. All Dance Kizomba Merchandise is printed to order by external suppliers and delivery time reflect processing production and delivery times accordingly. Please allow upto one month for delivery.
13.1 Dance Kizomba agrees to carry out the requirements of the customer in accordance with written specifications supplied by the customer to dance Kizomba and recorded in writing between the parties.
13.2 Unless otherwise agreed payment for the goods ordered by the customer shall be made when placing order. Title or ownership in the goods supplied by Dance Kizomba to the customer shall not pass to the customer until such time as full payment has been made, full payment being the receipt of cleared funds in respect of the whole order relating to the goods supplied.
13.3 In the event of the customer wishing to change the design, artwork or other aspect of the order, such request must be given by the customer to Dance Kizomba in writing. Dance Kizomba will use its best endeavours to make the changes in accordance with this request but must reserve the right to charge the customer the additional cost of any such changes arising out of this request, and will notify the customer of the costs such as changes at the time of the request. Dance Kizomba also reserve the right to amend the initial delivery time frame should any changes to an order be required. Orders requiring new artwork will not be started until artwork is signed by customer.
13.4 Dance Kizomba reserves the right to refuse return of goods is as a result of the failure on the part of external suppliers to supply the relevant goods in accordance with the order. Goods cannot be returned if individual design or embroidery work has been effected on such goods and/or the customer has used the goods and/or itself added the design or embroidery work.
14. Merchandise Returns Policy
14.1 Dance Kizomba uses external companies to print all orders upon purchase, we do not keep any stock of any item held in our shop. Because of this sometimes an item may be out of stock with out suppliers without Dance Kizomba being aware, if this is the case with a specific item a suitable product alternative will be offered and if no alternative a available a full refund will be provided as quickly as possible.
14.2 Returns can only be accepted where the product is deemed faulty, either in physical product or printing applied. In such instance a replacement product will be sent. Dance Kizomba may request the item to be returned before a replacement is sent.
14.3 If the customer confirms an order confirmation that has details on that the customer did not wish to receive on the order, the customer is liable for agreeing to these specifications, and Dance Kizomba will not be held responsible. So please check your order confirmations very carefully!
Unless incorrectly supplied or deemed to be faulty we cannot accept the return of:
- Goods that have been embroidered, badged or printed.
- Goods that have been assembled in line with your requirements.
- Goods that have been specially procured in line with your requirements
- Goods that do not fit but are sized as described
- Goods where the customer has changed their mind
Delivery Terms & Conditions
15 Occasionally Dance Kizomba will place a class order for merchandise items, where this is true the items (once printed and delivered to dance Kizomba) will be given to the customer at the next available class, workshop or lesson. If the customer is not in attendance to this class/lesson they are responsible for arranging a new suitable time for collection with Dance Kizomba.
15.1 All goods are offered subject to availability. Delivery of goods will be deemed to take place at the Customers address
15.2 Every effort will be made to deliver goods on time but no responsibility can be accepted for late or non-delivery. All shortages, damage or non-delivery of goods must be notified to us by telephone within 48-hours and confirmed by writing within 3 working days of dispatch.
15.3 Claims for shortages or non-delivery must be supported by the couriers POD and a delivery note which the goods have been signed as unchecked, short or damaged as appropriate.
15.4 By arrangement all deliveries should be carefully checked-in to ensure correct garments are delivered as no responsibility can be accepted thereafter for none or short deliveries.
15.5 Any damaged parcels should be checked in front of the courier’s delivery person and signed for accordingly.
